OpenCivics: Responsible Use & Disclaimer

OpenCivics makes certain AI-powered tools, models, datasets, documentation, and research outputs (collectively, the "Materials") available on an open-access basis to support healthcare-related research and service planning. By accessing or using the Materials, you agree to this Responsible Use & Disclaimer (the "Notice"). If you do not agree, do not use the Materials.

1. Definitions

"Outputs" means the content generated by or derived from the Materials (e.g., predictions, summaries, classifications, code, analyses).
"You" means any person or entity that accesses or uses the Materials, including on behalf of another person or entity.
"High‑Risk Use" means use in clinical care or triage; diagnosis, treatment, or prevention of disease; emergency response; medical device functions; policy or regulatory decision‑making; safety‑critical or life‑critical systems; or any use where errors could reasonably be expected to cause death, personal injury, or serious harm.

2. Scope; No Professional Advice; Not a Medical Device

The Materials and Outputs are provided for general research, evaluation, and planning purposes only. They do not constitute medical, clinical, legal, regulatory, or policy advice and do not establish any doctor‑patient, provider‑patient, attorney‑client, or advisory relationship. The Materials are not intended to be and are not a medical device or software as a medical device, and are not cleared or approved by TGA/FDA/EMA/CE or any other regulator. Do not use for emergency or time‑critical decision‑making.

3. Permitted Uses (Research‑Only by Default)

Unless you have a separate written agreement with OpenCivics expressly permitting broader use, your use is limited to:

  • Non‑commercial research, evaluation, benchmarking, and education, and
  • Internal prototyping that is not exposed to end users and is not used to make or support real‑world decisions about identifiable individuals or populations.

4. Prohibited & High‑Risk Uses

Without prior written consent from OpenCivics, you must not:

  • Deploy the Materials or Outputs in High‑Risk Use (as defined above).
  • Use the Materials or Outputs to make, support, or automate clinical, policy, regulatory, or commercial decisions affecting individuals or populations.
  • Represent the Materials or Outputs as accurate, complete, authoritative, or fit for any particular purpose.
  • Use the Materials or Outputs to process Sensitive Information (including personal information, health information, or other regulated data) unless you have a lawful basis, appropriate notices/consents, and technical and organisational safeguards.
  • Remove, obscure, or alter disclaimers, notices, or provenance.

5. Mandatory Consultation for Commercial/Policy/Clinical Reliance

If you intend to rely on OpenCivics Materials or Outputs in commercial applications, healthcare delivery, or policymaking, you must first consult with OpenCivics at research@opencivics.ai and obtain OpenCivics' prior written consent. Consultation is to confirm interpretation, limitations, validation requirements, and responsible use controls. Any reliance without such written consent is unauthorised and at your sole risk.

6. Independent Verification & Human Oversight

You are solely responsible for independently verifying the accuracy, completeness, appropriateness, and limitations of any Materials or Outputs before relying on them. You must implement human review and oversight, appropriate to the context and risk, and must not rely on the Materials or Outputs as the sole source of truth.

7. Accuracy; No Warranties ("AS IS")

The Materials and Outputs may be incomplete, inaccurate, outdated, biased, or otherwise unreliable (including through "hallucinations" or spurious correlations). To the maximum extent permitted by law, the Materials and Outputs are provided "AS IS" and "AS AVAILABLE," with all faults, without warranties, guarantees, or conditions of any kind, whether express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, non‑infringement, title, availability, accuracy, security, or error‑free operation.

8. Australian Consumer Law (ACL) — Important

Nothing in this Notice is intended to exclude, restrict, or modify any non‑excludable rights you may have under the Australian Consumer Law or other applicable law. Where the supply of the Materials constitutes a supply of services to a consumer under the ACL and guarantees cannot be excluded, OpenCivics' liability is, to the extent permitted by law, limited to the resupply of the services or the cost of having the services resupplied.

9. Limitations of Liability

To the maximum extent permitted by law:

  • OpenCivics will not be liable for any indirect, special, incidental, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, data, or business interruption, arising out of or relating to your access to or use of (or inability to use) the Materials or Outputs, even if advised of the possibility of such damages.
  • OpenCivics' aggregate liability for all claims arising out of or relating to the Materials, Outputs, or this Notice will not exceed the greater of AUD $100 or the amount you paid (if any) for access to the relevant Materials in the twelve months preceding the claim.
  • The above limitations do not apply to liability that cannot be excluded under applicable law (e.g., certain ACL guarantees), or to fraud, wilful misconduct, or death/personal injury caused by OpenCivics' negligence where such exclusion is prohibited by law.

10. Your Indemnity

You will defend, indemnify, and hold harmless OpenCivics and its officers, employees, and contributors from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Materials or Outputs; (b) your reliance on the Materials or Outputs; (c) your data, including allegations that your data or your use of the Materials infringes, violates, or misappropriates any law or third‑party right; or (d) your breach of this Notice.

11. Data Responsibility; Privacy & Security

You are solely responsible for:

  • Ensuring you have a lawful basis (and where required, informed consent) to process any personal or health information and to input such data into the Materials.
  • De‑identifying data where appropriate and implementing technical and organisational measures appropriate to the nature of the data and risk (e.g., access controls, encryption in transit and at rest, audit logging).
  • Complying with all privacy, data protection, confidentiality, security, and records retention obligations that apply to you. OpenCivics does not assume any data controller or processor obligations for your data by making the Materials available.

12. Third‑Party Content & Links

The Materials may include or interoperate with third‑party content, models, datasets, software, or services. OpenCivics does not control and is not responsible for third‑party content or services and makes no warranties in relation to them. Your use of third‑party materials is subject to the applicable third‑party terms.

13. Intellectual Property; No Endorsement

Except as expressly stated, all rights, title, and interest in and to the Materials are reserved by OpenCivics and its licensors. No rights are granted by implication, estoppel, or otherwise. You may not use OpenCivics' names, logos, or trademarks to suggest endorsement or association without prior written permission.

14. Export Controls & Sanctions

You represent and warrant that you are not subject to sanctions and will not use the Materials or Outputs in violation of export control, sanctions, or embargo laws applicable to you, OpenCivics, or the place where the Materials are hosted or accessed.

15. Changes; No Duty to Update

The Materials, Outputs, and this Notice may be modified, suspended, or discontinued at any time without notice. OpenCivics has no duty to update any Materials or Outputs.

16. Enforcement; Suspension

OpenCivics may suspend or restrict access to the Materials if we reasonably believe you have breached this Notice or are engaging in unauthorised or unsafe use. We may seek injunctive or other equitable relief to prevent threatened or actual breach.

17. Governing Law; Venue

This Notice is governed by the laws of Victoria, Australia, without regard to conflict of law principles. You agree to the exclusive jurisdiction and venue of the courts located in Melbourne, Victoria, for any dispute arising out of or relating to this Notice or the Materials, subject to any non‑excludable rights under applicable law.

18. Severability; No Waiver; Assignment

If any provision of this Notice is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force. Failure to enforce any provision is not a waiver. You may not assign this Notice without OpenCivics' prior written consent; OpenCivics may assign to an affiliate or in connection with a corporate transaction.

19. Priority; Entire Agreement

This Notice constitutes the entire agreement between you and OpenCivics regarding responsible use and disclaimers for the Materials and supersedes any prior or contemporaneous understandings on that subject. If you have a separate written agreement with OpenCivics, that agreement will control to the extent of any conflict with this Notice. Where both apply, the more protective provisions for OpenCivics' risk management and the more restrictive provisions on High‑Risk Use will prevail.
